Terms & Conditions
These terms and conditions constitute an agreement between Nigel Lord Photography (Photographer) and the commissioning Client, and may only be modified in writing.
Terms
Upon the mutual agreement and confirmation of an assignment, the Client is obligated to remit a non-refundable retainer of 50% of the total estimated production/creative fee (including all photographer-incurred travel expenses) within 48 hours of the assignment confirmation and prior to the commencement of the shoot. This retainer serves as a guarantee that Nigel Lord Photography will decline any other assignments for the date(s) confirmed. The payment balance will be invoiced upon assignment completion and payable within a maximum of 7 days of the delivery of approved images. By remitting the retainer, the Client acknowledges and accepts all the terms and conditions outlined herein.
- If the Client postpones up to one week of the confirmed shoot date(s), a fee of 25% of the creative fee will be added to the final invoice, along with 100% of expenses.
- If the Client postpones within 7 days of the confirmed shoot date(s), a fee of 50% of the creative fee will be added to the final invoice, along with 100% of expenses.
- If the Client postpones within 48 hours of the confirmed shoot date(s), a fee of 100% of the creative fee will be added to the final invoice, along with 100% of expenses.
Cancellations
If the Client cancels within 5 days of the scheduled start of the assignment (or the first travel day), or if Nigel Lord Photography is unable to commence the shoot due to unforeseen circumstances, the Client will be responsible for paying all expenses incurred by the photographer (such as non-refundable tickets or reservations) in addition to 100% of the retainer fee.
Client Representation on the Shoot
If the Client, or Client’s representative, is unable or chooses not to be present at the time of the shoot to approve test images, the photographer’s interpretation will be deemed as valid.
Inclement Weather During the Photography Session
Weather-delay days are typically billed at $500.00 per day for the photographer and $150.00 per day per assistant, plus all on-site expenses (or the agreed-upon per diem). However, if accommodation is provided by the client, only a full fee will be payable to the assistant.
Image Delivery
Low-resolution Internet ready images are usually delivered within 72 hours after the shoot for approval and final payment. Once full payment has been received, high-resolution images will be sent electronically upon request.
Image Reordering
From 14 days after final images have been supplied to the client, a $75 fee will be charged for reordering images, payable in advance.
Standard Image Licensing
As the copyright holder, Nigel Lord grants a non-exclusive, non-transferable license of usage rights to the client upon full payment of the invoice for the assignment. The license is defined as follows:
- As stated on the invoice under ’Usage”, the client is licensed to use images for customary self-promotional activities, such as inclusion on the client’s website, portfolio, social media sites, electronic advertising and marketing in trade websites, internal documents, and for typical press releases. Images cannot be used for the promotion of third parties (including villa rental agencies) without further compensation and the direct consent of Nigel Lord Photography.
- While we strongly encourage and support our clients in seeking editorial exposure, editorial use licensing can only be granted by the photographer.
- This standard license does not include commercial usage, such as real estate, national advertising campaigns in consumer magazines, product packaging, billboards, or any type of “broadcasting” through electronic media (including TV and on non-company websites like YouTube, Flickr, or other “share” type sites). Licensing for such commercial uses is available, but under separate contract.
Once again, a license may not be re-sold, re-assigned, sub-licensed, or otherwise shared with any third party for any reason.
This document may be amended based on specific requirements of a given assignment.
