Terms & Conditions
These are standard terms and conditions, and is an agreement between Nigel Lord (Photographer) and the commissioning Client only and can only be modified accordingly in writing.
Terms
Once an assignment has been agreed upon and confirmed by both parties, Client is required and agrees to pay a non-refundable retainer equal to 50% of the total estimated production/creative fee (as well all photographer incurred travel expenses) within 48 hours of the mutually agreed upon assignment confirmation, and prior to the actual commencement of the shoot. This retainer is required as Nigel Lord Photography will then refuse any other assignments for the date(s) confirmed. The payment balance will be invoiced upon completion of the assignment to Client and will be payable within a maximum of 7 days of delivery of approved images. By paying the retainer the Client automatically agrees to all the terms and conditions laid out herein.
Cancellations
If the Client cancels within 5 days of the scheduled start of the assignment (or first travel day), or we are unable to shoot through no fault of Nigel Lord Photography, then the Client agrees to pay all expenses incurred by the photographer (such as non-refundable tickets or reservations).
Client Representation On The Shoot
If the Client or Client’s representative cannot, or chooses not to be present at the time of the shoot to approve tests, the photographer’s interpretation will be deemed as correct.
Inclement Weather While On Location
Weather-delay days are typically billed at $900.00/Day for the photographer, and $180.00/Day per Assistant plus all on-site expenses (or the agreed upon per diem). However, if accommodation is supplied by the Client there will only be a full fee payable to the Assistant.
Delivery of Images
'Internet ready' resolution images are usually delivered within 72 hours after the shoot for approval and final payment. Once full payment has been received high resolution and or low-resolution images will be sent electronically within 24 hours.
Reordering of images
From 14 days after final images have been supplied to the Client, there is a US$60 (€50) fee for reordering images payable in advance.
Standard Image Licensing / Editorial submissions / 3rd party usage
Nigel Lord, as the copyright holder, grants upon full payment of the invoice for the assignment, a non-exclusive, non-transferable license of usage rights to Client, as defined herewith:
- The client is licensed to use images for customary self-promotional activities such as inclusion on Client’s own website, Client portfolio, electronic advertising and marketing in trade websites, internal documents, and for typical press releases. Images cannot be used for the promotion of third parties without further compensation and the direct consent of Nigel Lord Photography.
- While we strongly encourage and support our Clients in seeking editorial exposure, editorial use licensing can only be granted by the photographer.
- This standard license does not include commercial usages such as national advertising campaigns in consumer magazines, product packaging, billboards, or any type of “broadcasting” through electronic media (including TV and on non-company websites like YouTube, Flickr or other "share" type sites). Licensing for such commercial uses are available but under a separate contract.
Again, a license may not be re-sold, re-assigned, sub-licensed, or otherwise shared with any third party for any reason.
